1. Introduction

These Terms and Conditions ("Terms") govern your use of the website operated by Cerco Câble Canada Inc. ("Cerco Cable", "us", "we", or "our") located at https://www.cercocable.com (the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

2. Use of Service (Catalog & Quotes)

This Service is intended for product research and quote requests only.

  • Information Only: While we strive to keep our online catalog accurate, technical specifications, availability, and descriptions are subject to change without notice. In the event of a discrepancy between the website and the manufacturer's data sheet, the manufacturer's data shall prevail.

  • No Binding Contract: The submission of a Quote Request or the receipt of an automated acknowledgement does not constitute a binding contract of sale.

  • Official Terms of Sale: Final pricing, delivery dates, and specific Terms of Sale (including shipping tolerances, returns, and warranties) will be provided by a Cerco Cable representative in the official Quotation or Invoice sent to you.

3. Intellectual Property

The Service and its original content (including product catalogs, technical specifications, and logos), features, and functionality are and will remain the exclusive property of Cerco Câble Canada Inc. and its licensors. The Service is protected by copyright, trademark, and other laws of Canada and foreign countries.

4. Limitation of Liability

In no event shall Cerco Cable, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from: (i) your access to or use of or inability to access or use the Service; (ii) any errors or omissions in technical specifications or product descriptions provided on the Service; (iii) reliance on any information provided on the website prior to a formal sales contract.

5. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Province of Quebec and the laws of Canada applicable therein. Any disputes arising from these Terms or your use of the Website shall be submitted to the exclusive jurisdiction of the courts located in Montreal, Quebec.
